1 The Company (‘Everbrite Home Improvements Ltd’, ‘Everbrite Direct’ or ‘Everbrite’) guarantees to repair or replace free of charge any PVCu product, which develops a fault due to defective materials or manufacture within a period of 10 Years of the date of delivery.
2 Glass sealed units are guaranteed for a period of 1 Year of the date of delivery.
3 All moving parts (handles, hinges locks, etc.) are guaranteed for a period of 1 Year of the date of delivery.
4 All guarantee periods commence from the date of delivery provided that all monies are paid in full with order unless otherwise agreed.
5 This guarantee DOES NOT apply to minor blemishes or marks, unless written notification of such marks or blemishes is received with 48 hours of delivery.
6 This guarantee DOES NOT extend to damage or faults due to accident, misuse, neglect or installation.
7 This guarantee is given in addition to, and not in substitution for all the customers’ rights under common law and by statute.
This guarantee is non-transferable
8 All dates and periods of time given or specified by the Company within our website or otherwise are business estimates only and, although the Company will use its best endeavours to adhere to dates or periods of time given, the Company shall not be liable in any way whatsoever, for any direct, indirect or inconsequential loss which may result from the delay in the delivery of the products save where it is established that the loss was reasonably foreseeable and that the delay concerned was caused by the wilful default or negligence of the Company or its servants or agents.
9 The Company reserves the right to make minor alterations to the specifications of the product/s and or supply alternative products where the displayed item may no longer be available without prior notice.
10 It is expressly agreed that there are no agreements or otherwise between the Company’s representatives or agents and the Customer, or between the Company and the Customer other that contained in writing in this agreement.
11 Illustrations, photographs, descriptions, information and statements contained within the Company’s website, brochures and literature are intended only as a guide and do not form part of any contract nor do the same constitute any representation by or on behalf of the Company.
12 The Customer shall inspect the products upon delivery of the same and will then forthwith notify the Delivery Courier immediately or the Company within 48 hours in writing of any known defects or incorrect items as per this Agreement.
13 The Company reserves the right to sub-contract the whole or any part of the work hereby agreed to be carried out by the Company.
14 The Company shall not be responsible for or liable in respect of any damage or disruption to the fabric, structure, fittings or decoration arising in connection with the installation or use whatsoever of any products supplied under this Agreement
15 No variation of the terms of this Agreement shall apply unless amended in writing in this Agreement by the Company’s representatives, servants or agents.
16 The Company does not guarantee or agree that the installation of the product/s pursuant to the Agreement will eliminate condensation.
17 All the products supplied will be of good quality but the Company shall be under no liability in respect of minor blemishes and/or imperfections not guaranteed by the manufacturer or suppliers.
18 The Customer agrees and acknowledges that he/she has carefully read this Agreement of which is a legally binding Agreement between the Customer and the Company.
